I guess it depends... I would prefer to slog with weather in Canada for 3 years and get citizenship instead of stuggling for 4-5 years with desi consultanting company to get GC. My sixth year is about to start in december 2009 and employer has told that they will not sponsor GC. I am planning to take citizen ship from Canada and then move back to India. That way, anytime I want to come back to US/Canada doors will be open. I guess, there is no right or wrong answer, its a matter of choice.

A couple of months ago I joined company B and they transferred my H1B.
Now if I want to go back to Company A, do I need to transfer my H1B again?
Company A has not cancelled my H1 and I am in good terms with them.

I have been to the indian consulate couple of times and what I have seen so far is that people staying in the US take the consulate officers for granted.
People take the token and start filling up the form in the consulate itself, they will be at the window and will be pasting photograph or filling up the form itself on the counter.
I think the consulate officer should ask people that will you behave the same way at an US consulate??
People become impatient just waiting for 10 minutes as if they entire indian consulate has been waiting for them to show up at the office.
The way we Indians behave boarding a flight in US, the same does not happen in India. The way we behave with the consulate officers at Indian consulate does not happen at the US consulate. Why do not the same people trying filling up the form at the US consulate or try pasting photograph and even run to grab the original when they are at an US consulate.
We want the same level of professional at the Indian consulate then we need to show the same level of professional at Indian consulate that we show at US consulates.

Interesting observations Deepak. Issues are not very simple and are very deeply rooted to even think about changing them. To begin with there are tooooooooo many mouths to feed and people still dont realize the importance of population control:(:( Whe demand heavily outweighs available resourses then competition increases (basic to Darwinism). Primal instincts of survival come into play and behavioural modifications visible in the western nation are easily wiped off. Generally people have a desire that things be in an order but unfortunately due to the population stress prevailing in India, "disorder, corruption, favoritism" are the "order".
Will your generation be able to see this change? Possibly not?
Introduce the same stressors in the west and you will notice the same habbits surface here too. Natures way of dealing I guess??
One thing is for sure; If you practice non-violence in thought and action then chances are that your surroundings will ultimately reflect that same back to you. The way you react is most important than what the surroundings actually are. :D:D:D:D:D

It all goes back into the global cloud of emotions and thoughts that you and me subscribe to, to live through this life.....Putting good out and taking good in is the only thing we can do...

That doesn't mean nothing is being done. I am continuing to do a lot of work on this, but there is nothing new to post right now.
To date I have been able to get every newspaper in the country to do stories on this, as well as three scathing editorials in the NY Times, LA Times, and Mercury News, all of which slammed the government for its action.
I have worked with the staff of a member of Congress to ensure that house representatives were aware of the issue.
As a result, the house of representatives unanimously passed the HEART Act giving stimulus payments to affected soldiers overseas.
I have been able to get an important legal organization to review and research the topic for possible litigation.
I would love to go over the legal details with you, but it is not prudent to give too much detail here right now.
And finally, I have been corresponding with immigrants like you providing advice and updates on the situation.

Because most of the people here have smoked a weed called CIR and are halucinating. This bill is digging our grave, people wake up and stop day dreaming, please start opposing this bill no cir period.
Now Pitha, imagining you are fighting an oponent more powerful than you, when will you try to throw some blows? when the oponent is down on the ground crying for help, right? when somebody else has brought it down. Thats just what has heppened to the CIR, we all hated this in the form it was presented and now the big bully is down, face in mud. Now the core / our members should get on top and give as many blows as possible so that when it rises again it has a better face.

I disagree that this is a plan at the government level to make EB immigration on par with family based immigration.
Diversity is a cornerstone of the US immigration policy. It is present in both the main types of US immigration. You can argue about its merits and demerits, however when major immigration reform was debated and legislated in the 60s, diversity was set as a basis. The Diversity visa lottery speaks to this.
The H1b visa(with its absent country quotas), has now come into collision with an EB system which has these quotas. That is why we are seeing this mess.

If the information is stored as a segregated flat file, it won't take that long.
One could just proxy a perl/java gateway and write a script to parse data.
Who does it.. make all the difference.

There are issues at government agencies beyond the technical nitty gritty and my post was to point out that the skill set required is not the SQL/CRM of today. Suggestions such as we can offer expertise in return does not go any where as the systems on which the databases reside are not playgrounds, where we can write code and extract what ever we want. There are change control issues, security clearance issues, just to name two on top of my head. The total time for response is not just the time it takes to develop and run a computer program and provide us results. There are administrative issues at different level of abstractions at every org and CIS sure does have a bit more of that. All these consume time. At this point, the NRC response does not indicate time but indicates cost. We are trying to find the total time it takes to send a response back to us. Based on the response time, further action needs to be taken. It is illogical and absurd to just keep thinking technically. Take of your techie hat and think beyond. All comments in jest!
For those who are wondering big time that the country of charge ability/nationality is not captured in CLAIMS, you must have missed that stake holder meeting in which CIS clearly mentioned that it will take lot of $$ to re design their system to capture biographic information and will not be able to do so. Well, what can you say, even after raising the fees by 100% CIS does not have the money to serve beneficiaries who keep filing their flagship cash cow applications such as I-131/I-765. If some one still have the link, please post it.

First off it is quite frustrating with people not participating and not putting their money where their mouth is. However, on a constructive note, screaming at people for behaving the way they are behaving rarely gets them to meekly surrender and start doing the right thing. Whether people do it out of their own free will or after persuasion, it take courage for people to participate. What works is to look at the problem and not to personalize the issue. So poor participation is the issue. If you are consistently not getting enough people to attend then it makes sense to delay the frequency of the meetings as one option. The other option is to call people and ask why they were unable to attend and give them a chance to come for the next meeting. Maybe the projection of rounding up x people was based on poor assumptions. So setting realistic expectations and then building momentum from there is the key. This is a dry tough fight. We need to set up tangible goals which break the vision down yet show the grassroot level people how the baby steps will lead to success. Most people in my opinion, back off because they do not see a realistic connection between the baby steps and the final vision. I think if we treat this like a challenge and try to understand the underlying problems, this movement will have a better chance at success. Regards, JH

The U.S. Department of Labor today announced that it has begun auditing all permanent labor certification applications filed by attorneys at Fragomen, Del Rey, Bernsen & Loewy LLP. The department has information indicating that in at least some cases the firm improperly instructed clients who filed permanent labor certification applications to contact their attorney before hiring apparently qualified U.S. workers. The audits will determine which, if any, applications should be denied or placed into department-supervised recruitment because of improper attorney involvement in the consideration of U.S. worker applicants.

Couldn't stop writing this one liner to appreciate you sense of humor :D :D :D - hope we stop wasting IV server space and contribute towards positive discussion than a travel review site ...
The discussion is getting more and more interesting. somebody posted his/her experience with a particular airlines in the begining and lot of us joined in to crucify him/her for having said that. Then saxena came with his private jet and flight atendents and now saxena is getting rounded up. Interestingly UP/Bihar came up (knowingly / unknowingly) almost as a derogatory remark. Then somebody proved that its not UP/Bihar but south indians who are really hipocrites. In between all this somehow the airlines industry people escaped and are laughing. The final take seems to be something like this; We have chosen to be frustrated and if the earth doesn't give us reasons we will look for it in the sun. Either way we will reach our goals. Now let us make a tally of how many reds / greens each person got and find the winner.
Whenever and if at all I ever get to meet the creator divine I will certainly ask him how drunk he/she really was when he created the human brain.
Anyway sorry for interupting the "serious" discussion. Please continue...

everybody is quoting SFGate article can you prove the same , these ideas are addressed in article even kennedy says "Oh this bill will bring many issues of legals in to light " but not in numbers in CIR bill , if one reads the article he will think heaven is going to fall in CIR bill but reality is Its not heaven its hell as you the actual CIR.
Only time has to decide this week will decide whether indeed CIR resurrects ( chances are more than 80% if so current EB issue be addressed ?) lets see.
