I have changed to a new employer and have mailed AC21 documentation to the nebraska service center at the following address using FEDEX.

It is 2 weeks now that the mail has been delivered. So far I have not seen any soft LUD's on either my pending I-485 or approved I-140 cases.
- Would the LUD's be seen at all on these? How many days after sending the docs would you see the LUD typically?
- Is there any way we can call and confirm that the new employer details are applied on my I-485 case?

You will be out-ofstatus. And you need to find a job before 30-day grace period (it depends on the person who is handling your case) and move back to H1. Otherwise you cab either change to a different visa category if possible else you have to find a job and get your H1 through consular processing which happens to visit your home country get the visa stamped and comeback to US.
I am not sure about your previous H1B. if they have revoke your h1 then you cant do anything.
This is my opinion. But you can wait what others to say about this.

Hi,
My H1B was approved with a start date of 12th Dec 2010. However, the paperwork for the position has not been completed as yet by the HR of my employer and now they tell me that the start date of my position will be around the middle of Jan 2011.
This means that I will not get paid till the actual start of my position. So what is my legal status right now.
I have been told that on a H1B visa, If I am not working and getting paid for the position I was approved for, I am illegal.
Please advise me as I still have time to convey the issues to get the paperwork done right. What happens if my H1B start date is the 12th of Jan and my job paperwork shows position and pay from the 15th of Jan?

My sister filed 1-130 for me in 1997. I am currently living in the US on an H1B visa and the I-130 has been approved. As requested by the NVC, my sister submitted her affidavit of support (I-864) and paid the immigrant visa fee. However, I recently found out that I should have filed I-485 instead. I was advised that I cannot file the DS-230 because I live in the US. Is this true? Which could/should I do, DS-230 or I-485? Is there a way to get the immigrant visa fee returned?

Currently on H1B 8th year extension which will expire on 25th June, 2009.
Labor PD: 9th August, 2004
Labor cleared: 11th September, 2007.
I-140 (approval pending) filed on 4th October, 2007. Received at USCIS on 5th October, 2007.
Can�t file for I-485 since the EB3 date for India is unavailable.
There is a high chance that I might be laid off at my current employer in the next 2-3 weeks.

Hello,
I applied AOS in July 07 and was waiting for my and spouse FP till now. Last week I received FP notice for my spouse but her middle name on FP notice is spelled wrong. But her I-485 receipts and EAD are spelled correctly. What do I do ? Do I need to contact them and have it corrected before she appears for the FP appointment. Her FP appointment is next week so there is not much time left. I was thinking , that when she appears for FP appointment to let them know about the spelling mistake.

I spoke with TSC Rep today. I called up to re-check what lot of other guys are saying here that TSC no longer is honoring 180 day namecheck rule mandated by court few months back.
TSC Rep said she has no idea about 180 day rule but knows about FBI/USCIS joint effort for clearing name checks pending more than year, 2 years etc.
So atleast, my call suggested that some people at USCIS have no idea about 180 days rule mandaged by court.

Hello,
I'd like to know can a dependent (not the prime applicant) on a pending 485 status, avail unemployment insurance, especially the extended benefits which are being given by Federal govt. to the states.

My H1-B visa ended on December 31, 2009. I applied for a change of status to F1 visa on December 21st, 2009 towards the Spring 2010 (Jan 2010) semester. I received an RFE stating that I need to send a new I-20 for a valid future semester.
Assuming this new I-20 is for Summer 2010 (May 2010), my question is as follows - If my change of status to F1 gets approved and my semester starts 2 months later, am I allowed to legally stay in the country?

Guys. Is this 7% country limit a hard or soft one ?. Assuming 1,40,000 total immigrant visas, India would get 7% of it and that is 9800. Then you have the preference category. Assuming there are unused immigrant visas from other countries, how do they get allocated ?. Does anyone has clear idea ?.

This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). I have approved I140 (EB3, PD:Nov'04) from previous employer; after getting my MBA (Jun'06), I have changed the job and my job description has also changed. New employer will file the labor after 3 months (HR Policy)..I have good relations with previous employer, they are ready to file I485. Is it possible to file I485(previous employer), while I am working with new employer?
I am not sure but I came to know (not reliable source), that it is possible to file I485(previous employer) and during the interview, I can submit a support letter from the new employer. is this correct?

I am in the same situation. My I-140, with receipt date of Dec 13, 2006, is still pending with the TSC. Can you give me details of your pending I-140?
