Hello everyone,
Few weeks ago I had filed my wife's H-4 through my H1B. We have already received the receipt for her H4 filing. The H4 has not been approved or for that matter denied. She got a new job and she needs to start in few days. She intends to use the EAD that she got from our I-485 filing. She had never used her EAD before.
The questions I have is -
Do I have to do anything to notify the USCIS or let it be?
What will be implication on her H4 petition, will that be denied because she used her EAD?
Any suggestions would be greatly appreciated.

I will change my employer in April and transfer my H1 with my wife's H4. My wife has found some company which would sponsor her H1B. I am on EB2+485 pending. My wife is on H4(we haven't filed her 485 due to retrogression). I am very confused now. Please help me!
1. My wife's company would apply H1B on April the 1st. My new employer will transfer our H1&H4 after that. Will we have any problem here?
2. My new employer would sponsor me EB1. I have EB2+485 pending. If I apply for EB1 140+485, what will happen my old 485?
3. I am thinking to apply 140 first and if 140 gets approved, I will file 485. I am not sure if I have any risk here. Is there any chance that my EB1 485 gets denied? Do my EB2 485 and EB1 485 have the same chances to get denied?

I think you can't apply more than six months in advance from the date your H1 is expiring.

My wife came to USA on H4 visa in January 2004. Later when she got a job, she changed that to H1B in September 2004. Since we do not yet have the EAD or green card, her company is now filing the Perm labor certifcation, to make sure that she gets the 7th year extension of H1B. The rule is that you should file the labor before the 6th year starts.
My question is when does her 5th year ends. Was it on January 2009 based on her arrival in USA or is it on Sepetember 2009 sincw her H1B visa started only on Septemeber 2004?

Recently I transferred my H1 to another company. My H1 and my wife�s H4 got expired on last August 2nd 2007. However, the new company filed H1B application and it got approved 2 weeks back, but forgot to file for H4 extension for my wife. My company is saying they will file for H4 extension (I-539) now, even though her visa/I-94 got expired and she doesn�t have to go back home. Do you think they are on right track? I�d really appreciate if anyone could suggest me on this.

I have applied for OPT application (applied first time) in second week of May @ Vermont Service Center.
In last week of June, my employer filed H1B visa via premium processing and it gets approved within a week. H1B start date is Dec 1, 2010.
Last week, I received RFE for my OPT application stating that my status has changed to H1B. Please provide approval receipt. I have sent the approval receipt to USCIS. Current online status of OPT application shows that USCIS office received requested documents and my case is pending.
1. Will it affect my OPT application?
2. My original joining date is already postponed by 2 weeks. Still I am waiting for OPT card. Should I request expedite processing of my OPT application? or should I wait?
Please let me know. Thanks.

No, you don't need the I-864. The interview letter that you got might refer to an I-864, but this is often because the local district office has standard interview letters and they are more often for family cases than employment cases. I've seen this happen often.
