I would like to share my story with other H4 hopefuls and immigration voice.
I came to this country 2 years back. I am well qualified and had an excellent job in Bangalore with more than 4 years of experience in HR. After coming here I have not been able to get an employer to sponsor H1B Visa mainly because my skills sets are not in high demand occupation like Computers/technology but in Human Resource Management. I passed the professional certifications in HR in USA within 6 months of landing here and did get a number of job offers but was unable to take them up because I do not have an EAD.
In fact even my old company in Bangalore where I worked offered me a position here in their office and job offer is still on -provided I have a employment authorization. They are not keen to sposor H1b visa as they consider it too much of a hassle for a non tech employee.Also with the visa cap there are many hurdles to get through to get the H1B visa. Meanwhile our LC is in the backlog center and we are unable to move forward. My husband has received MBA admissions in some top schools in USA. But he had to give it up because of the GC process which seems to have now come to a stand still. When people who has come here illegally (if the bill passes) can now work legally - we who has come here legally and has followed all the rules are not given a chance to contribute to the economy and better our quality of life.
we are not going to go back -our GC is in process - so why shouldnt we be given a change to work while we wait for years for the process to be through. I feel that I have already lost my most productive years where I could have steered my career to H4 Visa rules.
I request Immigration voice to work on the issue of H4 work authorization.

Thank you so much for the reply. As you suggested, I will try to find an attorney and get more details. In the mean time I just have a few more questions.
1.Do you know if pay stubs would be a problem to get the "transfer/new" H1B before Oct 1st? Since I wouldn't actually work with Company A, so I wouldn't have any pay stubs.
2. Actually what's difference between getting the "transfer" before Oct 1st and getting a "new" H1B before Oct 1st? Is there some procedure difference?
Company A (the company through which I got the H1B) is withholding the H1B approval notice Original until I am put on project. I had the same question so I asked my attorney and he told me that you can "transfer" your H1B after Oct 1 and benefit from AC21, meaning that as soon as company B files an H1B petition for you and you have proof of this filing, you can start working for them.
However, I understand that you want to "transfer" before Oct 1, in which case company B has to file a new H1B petition either regular or with premium processing. This new H1B is not counted against the cap because you have already been counted against the gap in the 6 previous years.
In short, you should be able to work for company B starting Oct 1 if they file for a new H1B now and it is approved by Oct 1.
I recommend you ask an attorney for your specific case.

Its not a merit system, its a disguised diversity visa in the name of skills/merit. What kind of merit system will not have qualifying points? Its a shame that Sen Kennedy's website gave examples of how people ranging from 50-89 points can get GC's. Just call it diversity visa. Its a lie of massive proportions. When is Sen Kennedy up for election?

I heard from my lawyer today that my LC was finally cleared. When I heard the news, on one hand I felt a sigh of relief, but on another hand I was still feeling angry. It took almost 5 years to get the clearance in spite of being a simple straightforward case. I was simply exhausted with the long wait time and there was simply no energy left to celebrate. Though my LC has cleared, I still would like to join the fight against this injustice. If there is any effort on anyone�s part to address this injustice, I would like to support in any way I can.

I think the right way is for it to move laterally. If the govt wants 40,000 EB-1's it should get that number or atleast close to it. No point in some one in EB-1waiting for their GC when it filters down to a lower category. Also no point talking about why everything has to be equal. It is not, thats why they have set EB1,EB2 and EB3.Each requires a different skill set. People would not have raised this issue if this was an EB1-EB2 issue. Only because it is a EB2-EB3 issue there is so much outcry. If they have laterally used EB-1 if there was high demand in EB-1 no body would have raised the issue as they know what skills EB-1 needs. Now that it moved laterally in EB-2 some EB-3's who think they are as qualified as EB-2's is creating all this issue. Again you should have applied in EB2 than EB3 instead of raising questions on why EB2 moved forward.
Also its not like it is current or anything. EB-3 ROW is still better than EB2 India/China and for Christ's sake EB2 India was unavailable last 2 months......

I agree, India is a far better option.
Assuming this discussion is about immigration/permanent-settlement and not about short term visits, work and study.
On the side note, The only problem faced in india is over population which triggers almost all other issues. If india implements onechildpolicy most of the problems faced today will disappear in few decades. Your child (note: singular) need not leave india to enjoy international level lifestyle & benefits.
As a backup plan to greencard advocacy we need to lobby the indian government to implement onechildpoilcy immediately.
You do realise that one of the biggest reasons for India's rapid growth is it's population right? It is both a boon and a curse. And if you "enforce" a one child policy, there will be a rapid decline in population. There will be major social problems, what happens to a couple if their only child dies in teenage?. Apart from obvious social issues (kids will have fewer cousins and fewer relatives), the biggest problems will arise in 30 years when the severely depleted young populace will have to support the huge number of retired old workers either directly through parental support or indirectly through taxes.
Think of your old age too, these solutions look interesting, but it will kill the very reasons that make India attractive today.
A gradual stabilization of population by encouraging families to have just two children through social programs is the way to go and I think India has done a good job of it in the last 2-3 decades. These things take time.

As we have been learning, majority of the American public (including your neighbors) associate immigration reform with illegal immigration. Now if you ask them politely and ask whether they support immigration for highly skilled/highly educated individuals (already in the US working), you will hear no protests.
So basically, it boils down to awareness. When we have people affected by retrogression, unaware of the issues, how can we expect a lawmaker to know the inner details?

If you e-filed and no FP notice then you won't be getting EAD in 90 days.
The day you get FP notice from that at least two weeks after FP will be scheduled. After FP it takes 2 weeks to further processed (Card + approval).
Although USCIS says to contact after 90 days, you should think in terms of getting infopass.

Bush is going back to the Capitol hill next week to push for immigration reform. He is hell bent on signing a CIR bill no matter what and Kennedy and durbin know that this there best chance to give amnesty to illegals and screew us Legals EB so this bill is going to be introduced and will pass for sure

IV is more than a website. We are trying to build a grassroots organization. Things are taking place offline as well.
It takes time to build the base. Strengthening the state chapters is one of the best thing we can do. Our first chapter meeting was very small as well but we will build from there. More members are forthcoming to meet lawmakers now.
