Most of the employment related bills for skilled labor in the CIR were pretty much sponsored by Republicans.
I am wondering what kind of resistance, if at all, is the IV seeing in democratic controlled senate and congress seeing since these bills can be viewed as big business-supported or republican supported.
It would be good to get more democrats to sponsor these bills rathar just have them give lip service to our cause since they have the majority.

Hi,
I was working for Company A with whom I've my H1 & I-94 valid until Aug 2010. But I was laid off from Company A in Dec 1st week and I found a new job with Company B in Jan 3rd week. So I was out of status for about 6 weeks time.
Now Company B don't wish to file a transfer but instead they are filing something called H1 "Loose Petition", obviously I'm not going to start work with Company B until this H1 gets approved and I travel out of US, get restamped based on my New H1 petition, come back to US and start work for Company B.
But my question is, while from today until this so called "Loose Petition" H1 is getting processed (since they applied premium it would take about 2-3 weeks) can I legally stay in US (in terms of I-94 I've my I-94 from Company A H1 which is valid until Aug 2010)?
My employer suggest that I stay here until H1 processing result comes out and then leave country get restamped. Please let me know if you have an Answer.

When I joined my employer, I had MS+2 years of experience, but my lawyer applied to me under the EB3 category which had MS+2 as an alternate qualification. I submitted the experience letters from my previous employers.
Now, my company is willing to upgrade from EB3 to EB2 and have a position that requires MS+2, but the job responsibilities is a little different from the EB3 job.
If I apply for this position, will the USCIS accept the experience letters submitted earlier?

I do not see a problem in filing 2 Green Card applications.The one that comes first gives you a green card which most probably will be employment based.But you may consult an attorney as I am not one.
I am on H1 visa and I have a sister with citizenship.
I am wondering if I can file i-130 (family based immigration) now and file Employment based immigration later?
Is it OK to file 2 green cards applications? which one will take place then?

Hi,
I am stuck between H1B extn based on 6 yr and GC. My current H1B is expiring on 8th April 2011. I want to file for extn to recover my days outside US (about 60 days). Based on current processing time at Vermont processing center (6 to 8 months), I will not receive approval by end of 6 yr (about June 25th). My PERM was filed on 16-May-2011.
My company says it is not recommended to file for extn beyond 6 hr based on PERM pending if you already have H1 extn approval pending.
What are my options here to extend my stay beyond June 25th?
Appreciate your reply.

My mother is a GC holder since 91. I came to US in 2002 on F1 and then H1 and now GC.
Will the fact that my mom was a GC holder and I did not use that impact my GC? I have answered all the questions correctly(true i mean) always.

My 140 approved in May 07 and I had an LUD on 8-12-07.
AP approved a week ago and I had another LUD on 8-12-07.
I know a bunch of people had similar LUD on their 140s. I am thinking it could be a database issue. No impact..

Hi guys, cannot find this topic in previous threads. Appreciate it if someone can advise!
My situation is: I'm still waiting to file for I-485 with approved PERM and I-140. I'll get married right after I submit my I-485 when visa number is available and petition for her I-485. Can my future wife in China take consular processing in US consulate in China while I'm just waiting for approval in US? Normally, does she get it earlier than me since she'd ask for consular processing?

Hi,
I am in the process of changing employers and the new employer applied for the H-1B transfer on 4/11 at California Service Center (CSC). I haven't received my receipt number yet. Just wanted to find out how long it takes now a days to issue a receipt number because of the new H-1B rush during the first week of April.
If anyone has applied for H-1B transfer at CSC after April 1st, please update your status here to help others in the same boat.
Also, my start date is May 19th. Is it safe to join the new employer based on proof of delivery to USCIS instead of waiting for the receipt #.

This will allow H-1B visa holders from China to have multiple entries into the U.S. for a 12 month period.
