Did any one get their labor approved that are filed after June 2008? Does anyone know how long it is taking these days?
Is there any way to expedite it? Looks like perm is also becoming like old labor processing.

Current situation :
Labor approved(eb3 with pd of July 03),
I140 in process,
In my seventh year of H1b on a one year extension expiring in August.
Please advise if I can change employers now and still get a new H1 though I am in my seventh year ?

I have one white I 94 which you get at the port of last entry and three H1 I 94 (one original H1 I 94, two extention I 94s). The latest I 94 goes till 2010. Should I surrender all four I 94s or just the expired ones or just the white one.

Hi,
My attorney has filed our AOS on July 30th. She didnt had time foR filing our EAD & AP. So I'm applying myself.
My wife was out of status and is under 180 days. Her AOS will be considered under 245(k).
Now to file her EAD & AP, do I need to attach any Cover letter explaining her status? or the documents that are required will be sufficient? Please some one throw some light and let me know how to proceed.

One of the comments on my post earlier today about the killed Border Patrol agent seemed pretty harsh - accusing most BP agents of being restrictionists with bad motives. If it has been more than 90 days for the EAD renewal application and the EAD is about to expire, what can one do? I know they no longer give walk-in EADs. I have tried to contact them but no positive response. Any help would be appreciated.

If you are working on H1 then dont renew your AP, you can always travel and enter using your H1. If you plan to use your EAD pretty soon (or your H1 is expiring soon and you dont plan to renew it ) then apply 60 days before you plan to start using EAD and you should be fine.
You can even apply for AP after the current one has expired, its just that you wont be able to travel till you get your new AP if you have abandoned your H1 status.

Though my employer is located in Kansas, we got TSC receipts and now when I extended my EAD, I got NSC's receipts...(heard it is lreatde to laod sharing among SC's)
BTW Is this a big deal in approving 485???
Anyways, can someone pls direct me(if there is thread covering 2004 approvals) or share your thoughts around PD 2004 approvals?

Hi Guys:
My wife is out of country from October 2010. She was working on H1B. After birth of our son, she went to India for 6 month vacation. Will there be any issues if she re-enters US using H1B as she is having a job to continue with her employer.
What are all the documents I need to take.
Please advice.

USCIS updated its count of FY2011 cap-subject H-1B petitions and advanced degree cap-exempt petitions receipted. As of 8/20/10, approximately 33,900 H-1B cap-subject petitions were receipted. USCIS has receipted 12,600 H-1B petitions for aliens with advanced degrees. This is a major jump from the last update of August 13, 2010 where only 29,700 filings were reported.
Is this trend likely to continue? We think so, expect visas to run out by the early weeks of December.

Hi all,
My PERM labour certification was filed on 25th oct 2006, my case was selected for random audit on dec 06. My attorney replied with all the evidence for the audit. After reviewing the case CO at dol denied my case on Feb 07.
My attorney has asked my case to be reconsidered/reopen on March 2007 as they are confident that they have supplied all the documents required for the case. My attorney says it will take 6-8 months for DOL reopen the case and judicate the same which is Nov 07. what is best option i have as all the dates are current now? i have discussed with my attorney they have told me clearly they are not going to reapply as its a very big company and it will take lot of time for me to get clearance to file my perm again.
Does anybody having experience like my case can share your views it will be really helpful.
