Hi Folks-
We (5 People) work for IBM company, SFO, today we went personally to the congress men and we submit the letter which is provided in this forum and after that we called state senator office and we explained about our problem. We faxed and email the letter to the senator office, staff had taken my contact details and they told me that they will inform the solution in 2days.

For pre-adjudication, visa availability or the chances of PD becoming current is not necessary. They can pre-adjudicate based on receipt date.
My guess:
Probably they are processing all employment based applications right away so that they can prepare for CIR 2009. I guess Obama will take CIR this year itself as he has a very high approval rating and lot of goodwill now.
Number of immigrants allowed each year since 1900s. You would see big drop at/after every recessions/depression. Reports says there is already big drop in illegel migration at Mexico border. Govt offiials of any country would do anything and everything they can to control unemployment figures.

My wife's DL renewal is pending for more than 2 months...When we contacted DMV they said its pending clearance from DHS (homeland security) and it could take take 120+ days to get their approval.

I mean did your employer sent you the approval copy or the Online status changed ? The reason i'm asking this question because lot of times the Online status never changes for 3-4 months from 'Pending' to 'Approved'. When did you file your EB3 140 at NSC ? i filed in May 2007 - pending for 15 months by now.
Would you mind if i ask you when you've seen the LUD change before approval ?

I didnot have any LUDs on my I-140, On 08/08 I recd the approval email directly. The only LUD on my case was early this year when I filed AR-11. My employer did not send the letters, I was still convincing them to sign. My application was filed at TSC on 07/30/07 concurrent.

By the way, let me clarify that I have nothing against 2006 PD who got approved last month...but my frustration is against USCIS system who does not follow FIFO. Sorry if I have hurt someone's feelings.
This is really frustrating...moving EB2-I cut-off dates to Aug 2006, approving large number of 2006 PD cases and leaving 2003 - 2005 cases aside.

I am in too...How can we organize all the members...70,000 is a lot of people, Any thing done effectively and efficiently will make an impact.

For all those people who are gun shy, let me assure you, it does not harm anybody. On the contrary it is helpful to all of us. Please consider pulling the trigger. The fund drive that is happening today is not the last drive; as long as we are active, their will always be fund drives. Maybe you are thinking of contributing after seeing the effects/results of Sept 18th. In that case, I urge you to contribute now to get the maximum bang for your buck. Think about the Macy�s firework in New York. It will be rather boring to see them light one fire work each night during the month of July, just because funds did not arrive in time or were slow to arrive. Sept 18th is our 4th of July. However direct communication with Admins, Sharing of our strategy, developments etc will only be on donor forum. We do not anyways post it on open forums even now.
This initiative is to provide some incentive to members who support IV financially. In a couple of days we are launching another service to IV members that will be a big help. It will always be free for everyone and you will appreciate it. We are working on it these days.
There are some more ideas in the pipeline to even help all IV members. We just have 24 hours in a day, full time jobs and a life of our own. So we are trying to squeeze as much time possible to make this ideas be brought on IV quickly.

The lawyer I am working with also said the same thing. If 485 is denied in error (whatever is the reason, AC21 or not), one can file MTR and also continue working on EAD. Since the 485 was denied in error, the employment while MTR is being filed, pending will NOT be counted as unauthorised employment. If you read RG forums, he gave exact similar opinion.
I agree with Chandu, we should try to get this from CIS. Just don't know how:(
I am on EAD with an employer who doesn't understand or willing to work with any immigration issues. If my 485 will get denied in error, I will surely loose the Job, as leave without pay is also not an option for me. I wonder if I loose my job this way, will CIS consider this after an MTR or will again reject my 485 stating 'no job' as a reason?
