Reading through this, this only says that the status cannot be changed (to a PR). It does not say that the prefiling of of AOS application cannot be done.
I think we should definitely try to work towards this. There was also an article on Immigration daily (http://www.ilw.com/articles/2009,0225-endelman.shtm) which suggests pre filing as a administrative fix that will solve a lot of problems.
I am definitely in for such a initiative.

My understanding is they wait until last quarter to give the spill over. But this time they started giving the numbers in 3rd quarter itself. Keep in mind EB1 is current and Eb2 except I and C is still current.
I expect to see at least 20k visa's issued to EB2 I and C.
EB2 China wont take much visas because EB2 china PD cut off date was already Jan 2006 a year back. So it takes its reguler 9,800 visas for this 2008 fiscal year.

I am one of many many and happy to see this development.
I am puzzled.
Just would like to remind you all , only couple of months back, there was a great optimizm of CIR .. but today we know it is in stalemate.
So I think this time around we should be cautious. I have a question... What is the gaurantee that this bill is not to increase H1-B alone? Sorry If I am not being optimistic here.
I request, Our web faxes clearly state why we support SKILL BILL... If I read right and remember it well, this Forums goal is to reduce retrogression/backlogs.
Now to be positive I am copying an extract that was in quotes in press release ..

I could have told you that. I have never contributed any money to IV and probably never will. Because i dont think they are doing anything. First things first, If you want to take action, spend 41 cents every day and send a letter to your congressman or senator everyday for 1 year....For $149 per year (365 * 0.41 not counting leap years and counting on the fact that you will mail a letter even on holidays :))
At the end of the year, at least you have something to show for what you did. With IV, you can convince people that Patton Boggs is doing all they can for you, Trust them.
I am not blaming the Core at all, they are doing whateven they can given the limited resources, time and influence they have. But, what I am blaming, is the the "holier than thou" attitude which is adopted when distinguishing between those that are the exalted DONORS and those that aren't :)

If a regular IV member is spending 1000$ on credit card why cannot he/she not contribute 50/100 $ per month to IV. I don�t know about you or others but I use the credit card is gives best deal for the month for that month.
As far as contributing money to IV, again it�s not about monitory constraints but about making our self give some money for our own cause.
Well, If you sign up for IV credit card, the contributor is not paying from his pocket. It's the bank, who is paying for him, and contributor will keep earning miles/reward point as with any other credit card so it should make ZERO difference for card holder.
Its like finding a advertising sponsor for any of the IV event,except this is one time effort.

Any thoughts on organizing rallys state capitals ?
Good Idea...I had the same thought.....
We should do this rally in all the 52(?) states on one day to make it more historic!....This way the Local State chapters will get motivated and media will always be there on the state capital.....
Ideal would be a Friday afternoon....So people who don't want to take a day off, can just take few hours off and drive to the rally location...
People/Media will forget these rallies very soon, Once some OJ news comes up....we should keep on knocking the door!!! crying baby gets milk :) ....lets keep trying till our goals met!

Frankly speaking, i am not a sufferer from BEC, but i want to know more about this mess.
Does the FIFO means, they process the applications in FIFO order, Does it mean that they approve also in the FIFO order? I think both processing and approving are different. Whoever got the case with less complications, will first get the approval and whose case got more complications, takes more time. Is it correct? I may be wrong. I think thats the reason why 2004 PDs may come out BEC fast sometimes as they put the case strongly and clearly.

We may not sue DOL on their inability to clear the backlogs, but we can definitely sue them in their utter and deliberate disregard to FIFO procedures (mind that some people with priority dates in 2004, 2005 have already got their labor certifications, but some with priority dates in 2001, 2002 are still stuck). When I read on the DOL web site that they have tried to maintain FIFO, it makes me feel like puking.
Some folks have pointed that the lawsuit is not worth, as it has little chance of winning. To me personally, more than winning or loosing, it is a matter of bringing injustice to the light, as Gandhi has said something in this line: First step against injustice is to make it visible. This law suit will bring public scrutiny to the misdeeds of the DOL.
Even if all the backlogs get cleared by September 2007, severe damage has been already dealt to our lives. Though I am close to getting my labor clearance (I filed RRI few weeks back), I am strongly in favor of continuing with the law suit even after getting the labor clearance.
Let’s get IV’s attention and support in this area. Let’s talk to AILA. Let’s write letters to senators and house representatives (congresswoman Lofgren may be good person to start with). Let’s write to media personnel. Let’s do whatever needs to be done to expose this insult and injury to the immigrants who waited in the line for years and followed rules of the game.

If a measure that eases visa backlogs for highly skilled workers has to go through his committee, “that could be a problem,” says a Shadegg spokesman.

It is amusing to see that there are quite a few people who want the very door closed that they used to enter. It is even more amusing to see that the fault is always someone elses. It is similar to all the people who are opposed to immigration because it is someone elses fault that they are losing their job. Down right funny :p.
We need to focus on solving our problems without blaming others for our problems. Because once we go down that lane, we are no better than anyone from NumbersUSA or any other organization/ people who are against immigration. It is OK if we do not support increasing H1B - but saying that the H1B program needs to shutdown is not correct. I am sure that one can reason in the same breath that the EB3 category needs to be eliminated so that retrogression can truely be eliminated :eek:

having some kind of false promise of GC.
I know lots of IT guys from India fall for the Green card promise form employers even now (they say I applied and I should get in 2 years or so..

I see that a great contributor "AMMA" has come out openly about her inability to come though she had always the right intention in making it. She apologized to needhelp and this shows tremendous courage, self respect and pride in herself. I salute you 'AMMA'
But how many of those people who said they will come but did not, nor they called/informed had even sent a private note of apology. If they had sent that I am sure needhelp would not have felt so frustrated.
If I defend unprofessional attitude then I am one. If I do not come out openly with my identity in this forum and logs in anonymously, than I am a coward. If I am supposed to contribute but do not then I am a shameful human. If I can't apologize for my inactions than I always will carry the guilt forever. If I am a free-rider knowing I am not supposed to be one than I do not belong to this IV team.
Maybe is better for me along with murthy's or Rajeev's forum. There I do not have to contribute, never be called shameful/coward and my weakness, integrity, self-respect, character, idendity, etc can never be exposed. I can network, gain insight into immigration process, and forever wait for my GC and track from V/Bulletin to AP and whine/complain/criticize/condemn anything and anybody.

Logiclife made the reference to two sets of people. One who thinks EAD is the end of the road and it is ok to RSVP and not participate thinkers (not all of them though) and second to a completely different group of people who always logs in anonymously who he references as THE LURKERS ON THIS SITE WHO WILL NEVER REGISTER OR DO ANYTHING AT ALL.

We have a tendency to get prejudiced with few postings and never look into the original posting and the spirit behind it as page progresses.
How many times we have organized something but were frustrated by lack of support from people around us.. including our loved ones sometimes.
Now considering the sacrifices and efforts that needhelp did, isn't it appropriate to let her know if there is any change in plan, just as any accountable team member would do.
I see that a great contributor "AMMA" has come out openly about her inability to come though she had always the right intention in making it. She had made efforts, put posters in organizing it but she could not make it. She should have told needhelp but it slipped. This happens. She apologized to needhelp and this shows tremendous courage, self respect and pride in herself. I salute you 'AMMA'
But how many of those people who said they will come but did not, nor they called/informed had even sent a private note of apology. If they had sent that I am sure needhelp would not have felt so frustrated.
If I defend unprofessional attitude then I am one. If I do not come out openly with my identity in this forum and logs in anonymously, than I am a coward. If I am supposed to contribute but do not then I am a shameful human. If I can't apologize for my inactions than I always will carry the guilt forever. If I am a free-rider knowing I am not supposed to be one than I do not belong to this IV team.
Maybe is better for me along with murthy's or Rajeev's forum. There I do not have to contribute, never be called shameful/coward and my weakness, integrity, self-respect, character, idendity, etc can never be exposed. I can network, gain insight into immigration process, and forever wait for my GC and track from V/Bulletin to AP and whine/complain/criticize/condemn anything and anybody.

Friends Please dont jump on me as i make these comments. I am doing my best to convince ppl as i see across to Join IV and contribute to our efforts. But i also think that every state chapter should allocate some members who only concentrate on grass root efforts but nothing else to track how many memberships and etc and those should co-ordinate with every state to see how much they can target and how much did they reach. I know this might have been thought by some others but just what i am thinking ?
I will do 50+ from my side over the weekend , sorry shadowing till now will post exact as i mail all these. I will try to pump up as much as i can .

The discussion is getting more and more interesting. somebody posted his/her experience with a particular airlines in the begining and lot of us joined in to crucify him/her for having said that. Then saxena came with his private jet and flight atendents and now saxena is getting rounded up. Interestingly UP/Bihar came up (knowingly / unknowingly) almost as a derogatory remark. Then somebody proved that its not UP/Bihar but south indians who are really hipocrites. In between all this somehow the airlines industry people escaped and are laughing. The final take seems to be something like this; We have chosen to be frustrated and if the earth doesn't give us reasons we will look for it in the sun. Either way we will reach our goals. Now let us make a tally of how many reds / greens each person got and find the winner.
Whenever and if at all I ever get to meet the creator divine I will certainly ask him how drunk he/she really was when he created the human brain.
