    Going the earned path would not alienate many members who may not have contributed recently - but nevertheless are still contributing otherwise. People who have contributed in the past can be retroactively given access for a month for every $25 they've contributed.

    You stand a better chance of getting it through your kids if they are citizens than getting it through EB3. There are a few options to get green card faster. Canada is not one of them.
    1. Get a Ph.D, get a job in a univ and apply in EB-1.
    2. Get a MBA and get a management job and apply in EB-1.
    3. Become a religious worker in some temple and apply in the religious worker category.

    Fun apart, if you feel comfortable that you can find a job of your liking, and you believe your background will qualify you for a PR, consider Canada. It is a good place to live. You never miss home there. I am a Cdn citizen and have lived there for many years. Most likley I'll return back to Canada when I decide to retire. I know at least one person, who after living in the US for 11 yrs and unsuccessful in getting a GC, chose to make Canada his home, hoping to be there just for 3 yrs (needed to be a citizen), and then return to the US on TN permit. He has been in Canada for 8 yrs, and does not want to consider to move to the US any more.

    Canada has a bit slower life, but is better socially and people are friendlier. It has less professional opportunities, lower pay and more tax. Yet, overall I think Canada is a better place to live. Why am I in the US? Purely for professional reasons. I visit Canada quite frequently, which I consider as my home.

    These idiots forget that passengers are paying the airport landing fees and refuleing charges etc. Those who forget customers end up loosing business. We flew by Emirates last tlme directly to Dubai. It was excellent, took less time compared to landing in Europe.

    Every airlines has its onw set of issues - u will get the pinch only when shit hits the fan. My bags were stranded in Dubai and when I reached Chennai I had nothing with me except a small bag with no clothes.

    The agents told me - if you have Indian passport then Emirates will give you $$ compensation per day but if you have American passport Emirates will give $$$ per day. They reimbursed me for 2 sets of clothes and shoes and $50 per day for three days because my bags arrived one by one on the third and fourth day after calling them everyday and pressurising them. If we did not call them - the bags would come slower than that. In Dubai the bags were in hot sun and I had choclates inside and somehow the cover broke and choclates melted and seeped through and a I think you all can imagine how it is.

    What I am saying is - things are good everywhere unless we get into issues. Things were good until Retrogression hit us here. Now we complain about difference in treatment - but earlier wenever complained.

    What I am saying is - when dealing with things outside of your home country - you cannot expect or assume fairness to you.

    Since it is orginating from house. Also It may not be passed as it is. Subject to Amendments. For example there will not be oppostion to increase of h1 to 115k. But market based adjustment will have some opposition. In fact I heard one of calfornia Senator is opposing flexiblity of the Cap though she is accepting that h1 cap should be increased. Some debate also will be there in both houses and Senate has to vote again. Also EB category will have permanent increase in immigration, a few weeks of debate will be there. But we have to see how much oppostion will be there for EB immigration increase though there will not be much oppostion to H1b. Last year anti immigrants worked in backdoor and successfully delayed the the bill so that it can be killed. But this time also they will try to delay it because they cannot oppose the bill directly. Anyhow it may happen before this year end. Immigration is emotional topic for Americans as they fear their jobs are in risk though it may be or may not be true..

    It happened because of relentless canvasing of the media until the story got out and embarrassed the government. "Supporting the troops" is a no-brainer for a politician wanting to score political points. Most Americans could care less about immigrants or other citizens who are married to them. So there is no political urgency to solve that "problem." Although the media has reported that the exclusion of legal immigrants was "unintended," my sources say that the exclusion was intentional.

    I had hoped to embarrass the government further by exposing the connection to a known "hate group," but the media has refused to report that part of the story. If I could get the media to expose the racist origins of this law, we might have some hope, but don't count on it.

    The next phase is to focus on legal options.

    This is really interesting. Legal immigrants - their rights and well-being hinges on political points over which legal immigrants have no influence. Very interesting and disappointing at the same time.

    Indeed it makes no sense that people who have families to support get nothing, while those who do not have families get it.

    Anyway, it is not over yet. I have been able to get congress to approve checks for military families, so anything is possible.

    Unless Congress provides the necessary funding for managing the millions of applications under MBS along with Y visa, Z visa, new family based petitions etc etc, anyone would agree that the total time to get a green card will not be less than 9 years regardless of how many points you have or how early you filed for ur GC.
    The current gc backlogged applicants have already gone thru 5 years of never-ending wait time - this will increase by another 9 years.

    The option to file 485 after labor approval before priority dates become current is not present. It is not present in specter's bill either. It was present in S.1932 but current bills do not have that provision. I hope someone brings in an amendment to include this feature. This would help greatly for most of us.

    Just reporting what I saw on CNN. During the Sen. McCain interview with Judy Judy Woodruff & Richard Stengel, Richard asked something like - what about the green cards for the highly skilled immigrants educated by American Universities. To this Sen. McCain replied implying - they should be given green cards sooner, I am not sure if they could be given automatic green cards but the process should be faster.....

    He said it not exactly in these words but implying something to that effect. They were suppose to ask Sen. Obama the exact same questions. Did anyone see Sen. Obama's answer to the question about green card for high skilled immigrants from Richard Stengel? Just curious....

    I found this on shusterman's regarding obama's views on immigration. Looks like he is all for family based immigration but no mention about employment based.

    I have got an RFE for 485 application. USCIS is asking me for Employment Letter, Paystubs and W2 for the employer I NEVER worked. (I have typed exact message below)

    This is my situation-
    I worked for 'Employer #1' from Jan-2000 to Jan-2005
    Then I started working with 'Employer #2' from Jan-2005 to present. Employer #2 filed my H1/Labor/140/485. I am still working for Employer #2
    *
    However, I thought of changing job in 2006 and 'Employer X' offered me a job and sponsored my H1 and it got approved too, but I changed my mind and decided to continue with my current employer (Employer #2) and I am still with Employer #2. Please note my latest H1B was sponsored by “Employer X”, but I never worked for this Employer.

    Please advice-
    1) What should I send to USCIS? As I don’t have (can’t get) Employment Letter, Paystubs and W2 for “Employer X”
    2) Would you consider this as simple case or complicated?
    3) Should I hire attorney? (I self filed my 485 in July-2007)

    As long as you have had a valid h1b peition approved for employer 1 and employer 2 while you worked for them you are FINE.

    According to my lawyer there is nuthing like a h1b transfer. When someone decides to move to a new sponsor that new sponsor files for a h1b via the petition but nuthing gets transfered, they need to refer to old h1b just to prove thatyou are legal and have been maintaining legal status.

    in your case Employer X did so but you never joined that employer so you are fine. USCIS can get back to that emplyer if they have not cancelled your h1b as they are liable to pay you by law.

    For real as you had an approved petition (latest but not the greatest) from Employer X but did not join them you are fine as long as you were still holding a valid petition with Emp # 2. You should respond back to RFE stating that you were maintaining stauts via emp#2 and were offered a job by EmpX which you never accepted. As a proof you should sen copies of pay stub for enitre period and w-2 + peition and visa copies.

    Berry Scheniderman, Virginia. Horrible experience. They took 3 months to file for my H1B extension and then I was running out of time so I had to get it converted to premium processing. They simply sit on the case.

    Alan Heckler, (Specially the paralegal named Cathy)., takes months to respond . The only thing they are quick are at getting money. Totally unresponsive.

    Under current, LLC in Chicago , takes weeks to see the paperwork that you send and weeks to process them

    With Fragomen for 7 years now - right from initial H1B through work visas for - UK, Austria, Germany, Uk, China and GC in USA...

    I have nothing but great things to say about them... Yeah there were some small hickups - its only human - Nothing big though.

    I am sticking by them.

    Just because you are affected, it is wrong to think everyone around you are cheats. If you are so qualified and a real stud in technicals, get a job in Google or Apple. Go apply for EB1 or EB2. Get a green card. Get a life. Don't keep talking as if someone else has eaten your slice of bread. It is just because you did not try.


    I hate to say this and I hope I am wrong. All of us EB3 folks need to start speaking up or else our fate is sealed. I do not see any hopes of CIR passing. There is always going to be some political backlash due to the AMNESTY factor.
    From what I have seen, most employers are now filing only in EB2 category. They know that filing in EB3 will see their applicants backlogged so severly that there is no hope in seeing their applications approved. So, even those with less than 5 years of experience create resumes that show 5 years to qualify for EB2. Imagine the flood of applicants in EB2 that will pour in when the dates move forward beyond July 2007. There will be a new backlog of EB2 numbers that we have to wait behind. When are we going to get our turn?
    With nearly 10 years of experience and a master's degree, I am still languishing behind all these new comers who come here with fake experiences to qualify for EB2.
    We EB3 folks need to speak up, and have the spill over given to the oldest filed applications IRRESPECTIVE of category. The spillover rules from what I know were defined at a later stage and not as per the original law. If we cannot get CIR passed nor a piecemeal regulation, at least let us get the spillover changed.
    Or, let us en masse transfer to EB2 by porting, thereby making us all eligible for GC ahead of those that are coming in through the back door. I see them as no different from the undocumented immigrants. Breaking the ethical law at the expense of those of us who followed the law. Our positions did not require a Master's degree and I dont see why a programming position today still requires such. I also dont see why our experience today should not count towards qualifying for EB2.
    I dont care what or how many reds the EB2 folks give, but the fact of the matter is that we EB3 must join hands.

    As the saying goes “the proof is in the pudding" anybody can give statements but it is the results that matter. What results has compete america achieved, they are just giving lip service. Contrast them with the health industry lobby which has achieved results year after year. Compete america ultimate goal is more h1b which they will achieve one way or the other.

    Don’t get me wrong, I am not saying compete america is bad, I am just saying there focus is on H1b and not as much on EB relief. If they face a hypothetical situation where they can get either H1 or EB, they would gladly choose h1, that’s the bottom line. Its better to have somebody like compete america rather than nobody, but we need a corporate lobby whose main focus is eb relief.

    And there is an important lesson to be learned from the health industry lobby. They just did not say they want CIR or skil and then went back when both cir and skil failed. They started chipping away at individual items like 50000 visas for Schedule A last year and 90000 this year from unused\recaptured visas. We should also be asking for our individual line item, 485 measure. This is how a war is won, one battle at a time. It is unrealistic to have an "all or nothing" attitude that people opposing 485 measure have. If the health industry lobby had such "all or nothing" attitude they would not have got the 50000 visas last year nor would they have been trying to get the 90000 this year. Hope we learn from them.


    I am not sure about the statement "There is no corporate support for EB reform.....". Check this link http://www.competeamerica.org/. They seem to have the same agenda as ours (i.e., IV's). Is IV aware (or in collaboration) with them?

    I still like the idea of the "Gandhi" character. 10 IV members could dress like Gandhi, practice some coordinate steps and go for a parate on July 4th. That would be a pacific way to demonstrate our frustration.

    We just need to find 10 skinny, bald and friendly Indian male members. I am afraid that based on how this process has depressed our community, there are a number of us with the two former qualitities required.


    I don't think you should solicit members on the forum without fully letting us know the overall tone and message of your film. Where will the film be distributed and how it will be used? Who is funding your film? Get in touch with Immigration voice organization so that they can help you and let the forum members know if we should help you and if you will convey the right message for us through your film.
