Nurses are already under shortage occupation list, even though some articles says otherwise! Their visas stopped from Ja. 2007. US hospitals will definitley feel the heat within months, since, much awaited their nurses are on hold at their parent country. US Hospitals have already invested funds for their CGFNS, RN. petitoning etc. Their emergency rooms will be overcrowded.. and wards will be shut down.. if visas not approved soon. .. Senators have always soft corner in health industry.. and they will not allow public to feel the heat..Blocking nurses visa will definitely put us in bad picture before the american public..

I think we should write in only one thread about this VB mess until it is over. New users like me are getting hard time to find out the latest development of the VB issue. Either we should start a new thread or stick with only one. regardless of the subject/issue, we should post all our message into one single thread so that every one is on the same page.

Can we put up something like this Nursing shortage bill appeal page to send email or fax to the related Senators or Congressmen.

So, we should fight for this bill since it does not deal with the controversial guest worker program.

I appreciate this update logiclife. This is all I (and I am sure many others) wanted, an update.
If you see any bad word in my post, you can delete it and you have power to delete it.
I felt thay many members asked for update (and I know there is no crtitical update) once in a while from IV core team.
Any post from a IV core member makes this forum alive again and boost member's moral, as It shows that IV is still working.
I posted a -ve post as I knew that you will post something in response to it, and hence proved.
But using words like "barking dogs", God, I was not expecting that.
Ghost, something must be missing in your character but I don't blame you, its bad parenting.
Thanks
ForeverGC, this is not the right way to ask for an update. You are like a spoilt child demanding attention by throwing a tantrum.
I don't understand the point of people constantly asking for updates. Guys, we are a small group of people - 5000 members, only 1000 contributing - a small piece of the battle currently being waged over undocumented workers and border security. What can we, the IV core team, tell you? Every update is pretty much the same - we are trying to talk to Congressmen and put some provisions in the SKILL bill or other bill. What do they tell us? Keep educating Congressmen about your provisions, the same as you did for the Senate, and wait for the opportune moment or legislation.
What is the point of hounding the core team for updates? And your post, ForeverGC, just made me want to resign from the core group as you just picked a fight with several people, one that we now have to step in to moderate. This is just a waste of energy for the people who have to moderate.

This is a public and OPEN forum,
Insulting TheOmbudsman it's just not acceptable, I though we were all H1B educated people who are open to discussion, not just a child crying and insulting as soon as someone contradicts you.
I know many people who stopped comming to this forum (contributing), they just get tired of those insults. If someone has a different opinion, is immediately insulted

Just got the information from Murthy.
RFEs or Denials May Not Be Based on Wikipedia Information
The USCIS has been known to use an ever-growing number of publicly available sources, including internet sources such as Wikipedia. AILA members have been receiving denials based on the USCIS's use of information found on Wikipedia, an online encyclopedia to which anyone in the world may contribute information. As such, it should not be considered an objective or completely reliable source of information. SCOPS advised that it has notified the service centers and there should not be additional RFEs or denials based upon Wikipedia.
It should be noted that, as a corollary, applicants and petitioners should not try to use Wikipedia as support for their filings or arguments, since it has been deemed an unreliable source.

Transfer H1-b (dont have to apply for a new one)
: THIS IS COMPLETELY WRONG
I already posted this in another thread and I will post it again:
I am wondering when people will understand that H1B Transfer does not exist!
Everytime you want to switch employers, a whole new H1 must be filed.
People are always under the impression that because they already hold an H1, then it is easy to get "transferred" to another company.
In this case, the only thing you actually "transfer" is ...yourself and nothing else. The only advantage of already having an H1 is that you don't have to worry about the quota anymore, you are exempted from it.
Since you have to file a new case, approval can never be guaranteed and it is therefore always risky to switch employers (as soon as the new H1 is filed), without waiting for approval. Tricky stuff...
Check this from Murthy.com:
" Among the questions that often reach us, are those regarding H1B status and changing employers that refer to "transferring" the H1B. This term is frequently used, even by some immigration attorneys. The H1B is not actually "transferred" from one employer to another when an individual changes a job, however. We understand what people mean when they refer to an H1B transfer. We take this opportunity to explain the concept, though. This should help our readers to avoid misunderstandings as to procedure and requirements based upon the mistaken belief that the H1B is somehow transferable from one employer to the next.
MurthyDotCom
When a person is on an H1B and plans to change employers, what technically is filed with the USCIS is a new H1B petition, reflecting a change in employment, generally with a request to extend H1B status. Again, with the exception of the foreign national employee, there is nothing that transfers from one employer to the other."

I met a US citizen to whom I explained the situation. She immediately signed this letter and asked for a soft copy and is going to get all her friends to sign it. If people who have nothing to gain can help out so much, surely we can do better.

Thirdly you are using IV site for your agenda. Instead of supporting IV you are creating your own selfish agenda and not listening to IV. I have seen lot of offensive messages by you guys. You guys celebrated when all of us got screwed
I do not support your agenda.[/B][/QUOTE]
I DISAGREE WITH THE TERM "SELFISH AGENDA". I have read responses form the core team and I understand BEC issues are beyond the scope of IV's goal. However I think we should let BEC impacted members to mobilize, organize and communicate with each other through this forum. I feel strongly for them because I was stuck in BEC for a very long time too, it is an integral part of Employment based green cards to a majority of applicants. Even if we don't support them by being involved since we are not facing those issues, we must sympathize with people affected with BEC backlogs and give them directions, thoughts and good energy and wish them well..
I know behind the scenes core team is providing support, ideas to BEC impacted resources on how to go about and ideas. I think it is just commonsensical that IV cannot take up every issue and fight for everything. So that is why they are focused more on Retrogression caused by visa unavailability as their primary goal!
Hope we stop showing indifference among members and stop going at each other, its not worth dividing groups!

The real reason people are members on this forum and not attending meetings is because they don't want really feel comfortable doing that.
The reason you have 25000+ membership on this forum because all those who are here are on their own will and they love visiting this forum for various reasons.
The core wants to work in a more personally interactive model were people meet in real. But the crowd in this forum are all internet users who signed up because this is all done through the internet. If we want to be more effective there should be more planning on this internet forum and group activites focussed towards IV goals on this forum. Shifting from the internet model would be failure in terms of the numbers which we really are looking for.
I thought this will happen. People will oppose the post and find faults in Logiclife instead of themselves. There are several people coming up with their 2 cent ideas on this thread asking what IV must do and plan. But none of them want to do that themselves.
I think this is the real reason for failure.

You are right!!!. Hearing from the candidates, i was wondering if they will ask us to have some Voluntary Military/Community Service to be done to Qualify for GC and Citizenship.:D
dont be confused with "legal immigration", legal immigration in obama's world means family based immigration (vote bank politics) not EB immigration.

not necessarily.Level III can also be EB2.
http://www.hooyou.com/news/news080406perm.html
Current Developments on Prevailing Wage Determination
Along with the implementation of the PERM system, there were changes made to the Prevailing Wage Determination (PWD) process. The new PWD has a four level hierarchy where the first level is the lowest level. The prevailing wage is the minimum wage required that the employer must meet as determined by the State Wage Determination officials. The prevailing wage varies from state to state, as different State Workforce Agencies may determine the prevailing wage differently. After the adoption of the 4 level prevailing wage hierarchy, people have been worried that occupations requiring a masters degree might be put in the highest level of the hierarchy. In our practice of cases for positions requiring a masters degree, with an experience requirement of 2 years the PWD level has usually been set at the second level. Only for those senior positions specified by the job description or other management positions will the PW be bumped to the third or fourth level. As a result, as long as there is an experienced attorney who can make an effective design, the prevailing wage may be kept within a certain range.
If you scan the PERM data from fldatacenter. There are approx 3200 EB2-I (wage level IV)certified labors for PD up until 06/01/2006. Not sure about BEC certified labors. Based on the perm data ,DOS just needs approx 10000 visa number to clear the EB2-I PERM cases. I think DOS is right on.
Note: some of you have considered Level III in their calculation which is not correct. Because I am EB2 and my Labor says level IV for wage level.
