When exactly did you submit your application? I just called a few minutes ago to ask about mine (which was submitted early May) and the guy said I should not be affected by this as I should already be well into "the process by now" meaning I should have already been assigned a visa. He spoke very very slow...so I don't know if he was 100% sure of what he was saying:confused:

Guys, instead of fasting, protesting or marching, join state chapters and form big groups and then meet lawmakers. Request them for recapturing wasted visa numbers and removal of per country quota. this will solve most of our problems.

Its good that we have a democratic majority in congress. we also now have work cutout for us to contact new lawmakers. getting more members and members willing to work for local chapters is important at this time. we need to work with renewed vigour now and finish our task. pls help with increasing membership and join your state level chapter threads. I see only very few members have posted their interest. we need interest from each member in order to succeed. I am sure we will succeed. The good times are ahead of us but we need to take advantage of it.

This schedule will afford lawmakers even less time for consideration and deliberation than they had before. It will deny them the various procedures long associated with America's deliberative lawmaking process--hearings, testimony, committee debate and amendments, floor debate, and the possibility of further amendments. Instead, according to reports, this legislation will proceed based on an altogether new and expedited procedure designed for the sole purpose of forcing the bill's many ill-conceived policies over legitimate minority objections.
As it has before, for the sake of open deliberation and public education, The Heritage Foundation is making this legislation publicly available to encourage widespread debate and discussion. Yes , its Free :D Anyway - lets talk with a 3rd person (maybe USCIS) and confirm. Its Free, if you read the EAD forms its clearly written that once some one pays $340 ( not other amount) it becomes FREE for ever. I just checked the EAD forms again before writing this post - let me PASTE from EAD forms if that clear the confusion.

i am EB3 apr or may 2002 PD. In late 2005 i had asked my lawyer about switching to EB2 and she told the company that it would be a waste of money because our PD was 'so close' to being current. its 2008 and we are still 'so close' ;). i should have gone ahead and switched, now she says the same thing but i dont plan to listen. at the most i loose 6-9k...
i guess each one should take a decision on his/her own situation, without over analyzing. I agree with you that people with PDs 2003 and beyond should certianly consider switching.
PD Nov 2001 - Nov 2002 -> I would say no point in switching to EB2.
Labour + 140 will take atleast 12 months and another 6-9K US$. Not worth it because even otherwise you might have your GC within 12-25 montha from now.
PD Nov 2002 and beyond : Have to actively consider switching to EB2. Myself being in this range, I am doing the leg work and waiting to hear on what happens to the recapture bill. If it does not happen then these PD's should switch if they can and qualify.
Instead of being jealous towards EB2 bonanza , I think EB3 applicants should make use of this Eb3->EB2 conversion option and participate in the bonanza.
Yes, it costs additional 9K . Consider that the price of the ill advised decision to go in for Eb3 to begin with.
An opportunity to get past this GC mess and start realizing your dreams on both personal and professional front.

i sent an email to Senate Lieberman about the gap between the old and new system and h-1b extension:-
You might be the only Senate who cares legal immigrants and our contribution to US economy and its future. Some immigration attorneys and legal immigrants find out that the current CIR bill draft ends the existing employer-sponsored immigration system well before the inauguration of the merit-based point system. (please refer to Sec. 502 (d) (2) under Title V � Immigration Benefits on page 264 and 265 of bill text (SA 1150). If the CIR bill was signed into law, some departments would take time to establish procedures and it might be YEARS away to get merit-based immigration system ready for accepting applications. But the bill already ends the employer-sponsored system on �the date of the introduction of the [Insert title of Act]�. Can you see the gap between the old and new systems? At the same time, extension of H-1B is not possible if the immigration application filing is less than 365 days under the merit-based system. (please refer to Sec. 419 (d) (1) on page 239). For those who are already at the second 3-year of H-1B, we would face very unfair situation if the CIR bill were enacted as it is now: filing under the employer-sponsored system were invalid but the merit-based point system were not ready to accept any application yet. Previous time elapses until the H-1b couldn�t be extended after the 6th year.
I suggest to keep the current employer-sponsored immigration system running (accept new employment-based applications and the filing during such period is valid) until the merit-based system is able to process any applications and to reduce the 365 days to 180 days in sec. 419 (d) (1).
