They will definitely accept the copies of the check. The reason I applied my I-140 in May 07 and didn't got any receipt and I intend to file PPS for which I require copy of I-140 but when I talked to the customer service they suggested me this solution and after that I got my check photocopies from my employer

I think this is a great idea.
This is the holiday season and what better way to touch the chord of the Senators and House members but send one Christmas tree to each one of them. I am sure this would be a very emotional (in a positive way) appeal from IV for our cause.

I know everything, i have been following these forums from past 3 yrs, but i responded to the post by ksircar, he said "I think some SELFISH people with recent PDs are scared as people with older PDs may take the quota" which was inappropriate, cursing core members or people who are eligible to file 485 doesn't help right? that's all i want to say.
Here I want to make clear, FIFO for taking labor applications and sending ad instructions not for approving. I know depending on compilcation of cases(I think), some cases with PD 2005 get approved fast and cases with PD 2003 are taking longer. I dont know why all these mess in DOL, for taking the labor applications and sending ad instructions.

What about people with pending PERM applications?
The problem is quota of 90,000 visas is available for petitions filed before October 1st 2007. MBS will not start until October 1st 2008 (because of 270 days gap). There is no guarantee that BECs will process petitions by Octobet 1st either. Someone has to clarify if pending labor petitions will be eligible for the 90,000 quota or not. The INA section 212(5)(A) refers to labor petitions in general - PERM or BEC.

Damn, Mine and my wife's EAD got approved in 20 days!!(Paper filed on 6/5/2008), misssed the 2 year EAD by couple of days. :(:) I wonder, if we can call them and ask for 2 years EAD.

Since stay in India need to be very short and also my travel is very near, I need to know whether it is safe to travel on an approved I 797 from my current employer?
I already have a H1 B VISA stamped on my passport with previous employer's name that expires on 30 Nov 2009.
Also, I would like to know whether I should select yes/no to the following question?

Is H1B Transfer = H1B Renewal?

Based on the wording of the visa distribution law, it does not look like the pattern change is a permanent one. The pattern might change again as per USCIS whims and fancy.
Read the part "Nothing in this paragraph shall be construed to limit the authority of the Secretary of State to determine the procedures for the processing of immigrant visa applications or the locations where such applications will be processed."

go_guy123, since you have MS+MBA, you should seriously consider applying for US GC in EB1 category. I know a friend who had similar qualifications and he got this EB1 GC approved within a year. You need not be in US to apply in EB1 and you can do all the paperwork in Canada via consular processing. My .02 cents.
I dont think MS+MBA makes a case for EB1. Anyway I can look into it. Pease PM me some details/contact of your friend if you can give.

Hi,
I just got my H1B approved through company A with start date of 1st Oct 07.
Can a transfer the H1B to another company without working for company A?:confused:
I am in the US on H4 visa. I read that if you are in the US can transfer within 60 days of start date, and if you are outside US then within 30 days of start date. Is this true? Thank you all for your replies. It would be a big help!!

In which case, the employer is accountable for the employees. If the employer is honest, there will not be any employees who can take advantage of the employer's crookedness.
So, if there are a few good employees (which will be rare), they will have to bear the brunt. Kind of collateral damage. I feel sorry for those people, but I don't know what we can do about them. I'm sure that fraud employer is taking advantage of them too.

I had also used him before for H1B renewal, PERM & I-140 substitution with DOL (while case was pending with Backlog Center). He is very professional, humble, and always answers phone calls & email messages immediately. He is also very very affordable (shall I say inexpensive - see the amounts he charged me for H1B, green card processing etc below).
I was one of the unfortunate ones who got scammed my Earl David Associates (New York Law Firm) - now renamed to Jed David Philwin Associates. I know how bad law firms can be - they did not file my LC in 2003 but kept on telling me that they did - ONLY a year after in 2004 they promised me they had already done so. Needless to say how much pain suffering this caused me.
I used Andrew for my H1B + wife's H4 renewal - total attorney fees - $550. No extra fees for filing documents for family members.
Then, I used him for EB2 PERM, I-140, I-485/EAD/AP (for myself & my wife) - total attorney fees - $1600. No extra fees for filing documents for family members.
I had an existing LC approved from Backlog Center - he filed I-140 for just $100-$150 attorney fees - stating that since he had already filed a previous I-140 for me - he just needs to modify some minor details on the I-140 & file it.
He filed my I-485 over the weekend so it reached USCIS on Monday July 2 - who knows I may be one of the lucky ones when July visa bulletin fiasco is resolved.

Something seems amiss here ...the Wednesday & Thursday before the original CIR was stalled - Friday June 8th - there was a lot of tech industry lobbying with Senators including drafters of the bill - both ITIC & CompeteAmerica have releases on their website dated 06/08 - the day the bill was stalled- urging the Senate to take up CIR again - the following week there were press reports indicating some industry backed provisions would be included in the bill if & when it comes back or at least they would be bought up to vote. It is hard too believe that the list of amendments to be offered now do not contain even one single such provision. There is definitely something more than meets the eye here. It is difficult to fathom industry just watching from the sidelines & allowing 2 Sanders amendments to be passed

One thing I noticed in this thread is the lack of differentiation between attorney's who were hired directly by applicants as opposed to ones hired by the company one work's for.
I am sure there is wide gap in how law firms operate when interacting with either of the entities.
I would be interested in getting some references from people who have hired their own attorneys and their experience with that.
Even I am looking to hire an attorney to transfer my wife's case and then join the waiting game..
