The USCIS/DOS set quotas for visa numbers because the United States does not want to be overwhelmed with immigrants. And these quotas are spread evenly through all nations and ethnic backgrounds. Considering the populations of the "oversubscribed" nations, this is justified. I can see where the immigrants from these nations feel "discriminated against" in the fact that they receive a smaller percentage (NOT NUMBER) of visas per capita than ROW countries. This does not make the system unfair. And if you think that certain countries get special treatment, think again; there are plenty of people in ROW (like me) who have been waiting for years as well!

Why don't we concentrate on state chapters.. that surely makes some big difference. We were able to apply for I-140 and I-485 thats a huge blessing. But do we have enough time to motivate our EB friends to join us and meet the law makers, signing letters etc... If we have many active members we would have achieved something.

They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.

I am not on AF payroll, so please don't use your choicest abuse on me if it seems like I may be defending their actions a bit here. What I really want to do is give my experience with AI and the facts that comes sout of it and see if you would agree something similar could have happend with our fellow citizens on AF.
I was travelling on AI ORD-MUM via FKFT. Similar to what happend at CDG airport, just minutes before my plane was about to land at FKFT, the right engine shut off and at FKFT airport, it was reported that a mechanic from London etc will have to fix it. After 3 hrs it was reported that it cannot be fixed and a new plane from somewhere in Europe will have to come and carry us to Mumbai. In the meantime they gave us coffee and fruits. Old and people who were less able got some blankets etc to lay down, but in general, mist of them were just loitering inthe airport. AFter 5 hrs or so, all US passport holders (and of course EU) were told, they could go out and stay at a hotel and come back next morning, which would be the earliest the plane would take off. All the Indian passport holders were told,we could not go out due to visa restrictions. But AI started negotioations with the Polecie of Germany to see if we could get some type of temp visa. 12 hours after the start of the ordeal AI was able to obtain a group visa for us at midnight from the German Policei. Note that most of the admisnistartive work to get the visa was really managed by the Indian passengers themselves. Ther was probably 1 AI personnel to do/direct some of the things, but after a while the polecie started talking surectly to us on next steps.. All through this we went to have 3 scerurity checks at different points in the airport. We were put in the same hotel ( as swanky Marriott in heart of FKFT) as the US/WU citizens. We spend the next 36 hrs(yea, there was no plane from Europe to carry us) in the hotel before we got a plane from Mumbai to take us back.
So putting all this in context, I was happy that AI did help us when the situation was dire.with hotels and food etc. But they cannot help you with the Visa situation. I am assuming that it was the same predicament for AF. I agree not treating the pasengers well in terms of politeness, food , temporary lounge etc is not an excuse, esp at CDG which is AF's home.

Is the efforts of EB3 (I) volunteers being exploited (indirectly, ofcourse)? What are they fighting for?
I don't see how. If the bills pass, then everybody in queue benefits. Simply switching to EB2 is not going to work because it is also retro. The people impacted by retrogression should take the lead in fixing the mess.

Let us give IV Core a few more days to think through and recommend the next course of action. Many must have returned home from DC only yesterday after being present even on Wed. after the majority of us had returned.
I currently have 450 unread emails in my inbox. I Have not been able to catch up on those due to busy schedule before the rally and the travel to DC. We have some plans for post rally action items and are also watching how the current bills and amendments are progressing.
One action item everyone should do at this time is to:
1) Join your state chapters if you have not.
2) If you have already joined your state chapter, then get active and lead it if there is nobody to lead.
3) Contact your state chapter lead and plan some local chapter activities/action items to strengthen your group
4) If you attended the rally/were a witness of the rally events on the forums, then spread the message about our success to all your friends and contacts and urge them to join this effort.
This is the time to make ourselves more stronger. We have already established ourselves as a major voice of this community in DC. Now we need to get ready for the legislative work. Such work will need much more support from everyone and we will surely succeed. With each success we are gaining more confidence and strength. Support from lawmakers for us is also increasing and we should all be proud of it.
Lets continue to make our IV strong.

Canada and Australia are good backup options. You want to apply for one of these countries as a backup while waiting for your GC.
I m a new applicant for EB 3 gc born in india.....just starting my process......with my PD being sometime in later half of 2009,do u think canada is a better option?......EB 3 india right now looks like a good 10-12 years wait time!!.......pls advice about canada immigration and is it a viable option?

PD, I don't agree with the phrasing of the new Labor Cert clause. That is not how I read Frist's bill. Did you make up the new labor cert clause yourself?

There is no minimum number of weekly hours for an H1B petition. There are some H1B workers who hold several part-time positions. This is common particularly in academic settings where individuals may teach part time, or where a single position may be funded by more than one source. (This requires multiple part-time H1Bs.) Thus, potentially it would be possible to obtain an approval of an H1B for just a few hours per week.

Appropriating ALL unused EB3 visas from previous years, AGAIN, for Sch. A workers is what is being attempted to be stopped.
We are vehemently opposing and demanding such unused EB3 visas be allocated to all. We had already faxed to important members of Congress to stop this. Please read/browse the entire thread before you even attempt to post your first post.

If the EB system is categorized by country quota, what is what would be the apparent use of capturing data without the unlerlying country of origin of the applicant?
If the data is truly not available, what system are they using to anticipate demand and inform the DOS?
Based on the reply to this FOIA from Needhelp!, it seems that we have a bigger problem than transparency.
They have said that country of chargeability is not assigned until case is ready for approval. However, whether or not a case is ready for approval is determined by country of chargeability. If you have 500,000 pending cases and dont know how many cases for each country of chargeability, then the only way to respond to a visa bulletin is to go thru all 500,000 cases every month, take a peek in it, look at the PD, look at the country and see if it is up for approval. I dont think they are doing that.
Also, if priority date is something that is different for different countries, then cases for those countries have to be sorted by priority date in different silos, so that when the next bulletin comes, you know how many cases are eligible that month and which ones are the earliest cases (from PD perspective) for each country.

the world is not fair, I am willing to fight my part to make it fair and just for all.
Kartik, as long as we, the EB3 do not come forward and collect huge amount for lobbying, we will continue to lurk here for many more years.
Unfortunately the sad part is, whatever lobbying is done actually helped only EB2 I, may be due to a wrong notion by USCIS that all Hi-tech immigrants are EB2. This could be a fact as there are thousands of 245 cases that fell into EB3.
Another bad thing was that USCIS release this VB yesterday which means one extra day to CRY.
I do not blame any one, but ourselves. We do not want to spend money and hence dying in this process. No solution, but cry at every VB day.

Based on Visa Bulletin report, it seems like massive retrogression is likely for EB3 as well as EB2 :( for the rest of the year. Many have ported and some hibernating applications are now active. :(

We are seeing now the fruits of our efforts.

Despite a difficult year for immigration, there is movement of Bills for us.
The admin fixes campaign has also been successful. It is now a matter of time when administration chooses to make an announcement. We have been following up with them on regular intervals. The phase 2 of our campaign has also been going for past several weeks. Several state chapter members have traveled to DC and lobbied. Core has also traveled to DC to push for our provisions.
The latest good news is the bill on Recapture. IV has been on the front lines to announce all these developments and our lobbyists have been lobbying hard for us. All this effort costs money and thus we are starting a funding drive after a gap of 4 months so that we can continue this momentum. The more we can raise, the better we can lobby. We have a target to reach at least 50K in this funding drive so that IV can continue to be a voice of immigrants and take up their issues on the hill.

I got the approved mail today, even though my PD is May 12, 2006 and the current bulletin date is two months behind. I hope this was not a USCIS mistake. My category is EB2 I, center Nebraska, Notice date Aug 17, 2007.

One of the required documents for PIO card is (apostilled copy of the US passport holder)
just wondering what did you do to get the documents apostilled ?
I tried looking for an answer, looks like it is a long procedure and you have to get it certified by the US dept of state ???
So I applied for a 10year visa for my daughter and they issued in 8 days from san francisco.
