What are we supposed to do now?? we should make this an IV campaign issue. USCIS is not following the rules set by congress. AC-21 is the law and USCIS is not following the law and causing hassel to the legal immigrant community. The legal immigrant community should really do something about this.
I will wait for Denial notice. My attorney might get it mid next week if USCIS send it today.

I did a one time $100 contribution during 2007 Fiasco as i know it was all because of IV. I stayed away from Donating to IV after Donor - Non Donor fights.
I know IV is doing wonderful job and i want to chip in here....Before that i want to know if this is separate drive or can i get Donor status?

Thanks for an encouraging eyeopener. Now that people are using their freedom of speech and figments of imagintion vividly, let me use mine too, with a bit of humor.
Unfortunately only EB(I) will be able to associate with this, so apologies in advance to others.
It's 2018. Two indians, namely Ajay and Vijay meet in a grocery store aisle. Ajay inadvertently drops a carton of tea and Vijay try's to help pick it up. They exchange nicieties, shake hand and WHOA... Ajay noticed that Vijay's got a big EB2 tatto on his forearm...Without a moments delay, Ajay folds his sleeve and shows his own EB2 forearm tatto to Vijay. Ajay and Vijay become friends forever....
On the same evening.....Seeta and Geeta are shopping for tamarind in a nearby aisle....for some reason (I cant be more vivid than this) they notice eachothers tatto's; one has EB3 and one has EB2..........CATFIGHT!!!!!!!!!!!!!!!
Morale of the story : Lets stop the drama and get busy helping ourselves..if you want the above scenes not to translate to reality....
Can't we all just enjoy lessons taught to us by Bollywood......If you have hard time coming to terms with the above scenes , please close your eyes and go back 30 yrs into
indian cinema....

Remember that these numbers are first categorized and then assigned to applicants on a per country basis. In other words, a visa number if it is EB2, should be assigned to EB2 (no matter what) before it goes to EB3. If it is EB1 visa number and for it to become a EB2 visa number, there should not be any need for that number in EB1 category.

A lot of people argue that these categories are not defined as hard and fast percentages, but that rather the definition of EB-1 already includes spill-over from EB-4/5, EB-2 includes spill-over from EB-1, etc., and that 202(a)(5)(A) actually refers to already spilled-over categories (i.e. the place where they talk about the total number of visas).
I guess this point as to how exactly spillover happens is very moot, and the law is quite open to interpretation. They should have really defined this more clearly with the AC21 amendment, rather than have people waste their time with lawsuits and stuff like that.

The key criteria here is an approved I-140 + I-485 pending for more than 180 days. My understanding is that if you do not satisfy both clauses, you will have to re-start the process again when you change employers

My Lawyer didn't file my I-485 until July 7, 2007. He never replied to my e-mails or my phone calls.
My whole experience with them appeared to be as if I know more than them. It appeared as if I had to educate them about the development.
Considered changing lawyers and also considered filing on my own. But finally thought to ahve atleast soem attorney whom i know(at least i know what can expect?).

I don't have any choice other than going with Fragomen because of employer restrictions... they are very slow... I have found that they only respond to the HR emails -- they will never respond to your emails and you will keep on waiting for replies for weeks together...
My LC was approved in Feb.. they took 4 months to prepare and file my I140 application which is most probably the simplest application.... After the dates became current in June - they took 10 days to send me a list of documents required for I485 despite several emails... That too happened after HR intervention.
I am fortunate that my GC process was started by other law firm... They filed my application in EB2 otherwise I am pretty sure that Fragomen would have gone for EB3. I have been with another law firm that started my GC process,,, and trust me -- it was much much better than Fragomen in spite of being a large law firm.
Fragomen should stop taking clients if they cannot handle the load... Phone calls made to their lawyers/paralegals always go to voicemail --
Don't use them if you have a choice.

I have contributed several times in the past and was also a monthly subscriber of $20 until I closed my credit card account due to a fraudulent transaction. I had been in bench since the beginning of this year ( down but NOT OUT :) ). Fortunately was able to get a permanent job just last month. This means moving to a new place. Therefore I am not in a position to join the advocacy efforts at DC. Wish IV the very best and I am sure our efforts would not go in vain. I am an eternal optimist and so I am confident that our good days are round the corner.:D

I had emailed CIS Ombudsman's requesting temporary relief in such uncertain times...by allowing ppl to file for AOS..even if their PD is not current.
They replied to me ..but i think a more co-ordinated and deluge of such requests will make them take this issue seriously.
So what did his office say? Is there a new OB in office yet?

Its personal choice if and when they want to start the GC process if there is an opporunity. I also didnt start my GC even though my first employer wanted to start the GC for me in 2005 and I refused for whatever stupid reasons...which I am regreting now
Yeah me too, in 2005 a company wanted to apply for me in EB3, though I was qualified for EB2. I didn't feel it was right to apply in EB3, unless you were a fresher.
I quit and joined an Wall street company in 2007, who finally applied in the right category

I know you have been correct in the past but I think we have just gotten over the hump of 2003 and a small portion of 2004 for EB2. The majority of 2004 and early 2005 still remains. There was a huge jump in March 2005 to beat PERM. I dont understand how it will reach 2007
