Hello,
My original I-140 in the EB3 skilled category was denied by the TSC & is pending @ AAO because the attorney's cover letter asked for the application to considered in the professional category, instead of the skilled category.
I have been told that while that I-140 is pending at AAO I can file a new I-140 under the "Other" category &they will adjudicate that case on the same Lobor Certification. Is that accurate for the TSC?
We will also file another EB3 Skilled category I-140 which obviously will be kept in abeyance till the AAO rules on my original application.
Can an attorney please advise if I can have 2 I -140's on the same Labor Certification for different categories?

Guys,
I am on L1 .My wife is working for a Indian s/w MNC and was earlier in L1.Once her project got over they sent her to India.She applied for vacation and came here on L2.During visa stamping the officer cancelled her L1 visa in passport.We applied for her EAD in July and are expecting to receive it in a few days.This is the first scenerio.
Secondly, we applied for 485/140/AP/EAD in the second week of Aug 07.No updates yet with regards to cheques/receipt notices etc.
We tried to contact her company's office here to look out for employment based on L2 EAD.But they mentioned that they wanted her to goback and come here again on her company visa.I really cant understand what is that for.
Now the question is
1.Is it safe for her to change to L1again and have visa stamped in India given our situation of GC.If so when.I mean after receipt notices/finger printing etc etc?
2.Any idea of y these companies doesnt employ their own staff who are in EAD.
Any one gone thru any of the above situations.?

Hi one of my relative has cleared the US citizenship exam. He is waiting for the oath. He want to visit canada after a month. Before the canada visit I think the oath will be done and he will become citizen of US. He can not get the US passport instantly.
My questions:
1. After becoming US Citizen can he visit canada without US passport? If yes what docs he needs to carry with hi?
If no then what to do ? asking because he want to visit canada and can not get passport withn 15 day.

Did anyone get their 140 approved from Vermont?
My 140 and 485 were filed late July 07 in Nebrasks and I got notices stating the 485 was transferred to Texas and 140 was being processed in Vermont.
The Vermont processing time for 140s has been stagnant at April 2006 for a long time.
Wondering if anyone has any updates on this.

My 485 is pending and and I am still working on h1. I have EAD and advance parole, but do not want to use parole to go to canada (Wanted to save it for India trip). Do I have to take canadian visa to travel to canada for 3 days based on my currnet status. what is the process to take the visa?

2 - You can work for multiple employers using EAD. Typically EAD will not have any restrictions other than how long it is valid for.

I am planning to invoke AC21 thru H1 Transfer and then notify upon H1approval.
Do we need to make sure while filing H1 transfer, job duties on H1/LC should exactly match Labour Cert job duties?
I know while notifying it has to match.
Appreciate your help.

The study found that immigrants arriving from Mexico fell by 249,000 from March 2008 to March 2009, down nearly 60 percent from the previous year. Keep an eye on the military appropriations bill Congress is working on for a potential immigration piece. The AP reports that Republicans want some serious money and personnel commitments for the southern border. And my own sources are telling me that some Democrats are looking at trying to get the DREAM Act in that same piece of legislation. Remember, DREAM allows for some who join the military to pursue permanent residency so it would be a germane part of the bill. A down payment on comprehensive immigration reform? Or the end of that effort and the return to piecemeal legislating?...

On March 19, 2010, the USCIS announced revised filing instructions and addresses for applicants filing an I-131, the Application for Travel Document.
Beginning March 19, 2010 applicants will have to file their applications at the USCIS Vermont Service Center or at one of the USCIS Lockbox facilities.
If you file the I-131 at the wrong location, the USCIS Service Centers will forward it to the USCIS Lockbox facilities for 30 days, until Monday, April 19, 2010. After April 19, 2010, incorrectly filed applications will be returned to the applicant, with a note to send the application to the correct location.
