Hello All,
I received a "Notice of intent to Revoke " on my approved I-140 recently. By gods grace, my company was able to get my I-140 reaffirmed.
The status on the USCIS website states as follows.
".....we mailed a notice to you reaffirming the approval of this case and returned the case to the Department of State for visa processing. For more information, please contact them directly."
We did NOT request for consular processing. Does any one know why USCIS send my case to Department of State?

here is my situation.
FP done in Nov 2007. Planning a trip to India in Dec 2008 to Jan 2009. What if I receive biometrics during this time? After 1 year of FP, I anticipate that there would be repeat Biometrics done.
Is there a way for us to request Biometrics early? I am going to renew EAD and AP 4 months before expiry (expire in Nov 2008). Will this take care of Biometrics renewal as well?

ideally I expected GC to be done before my trip BUT strange are the ways of USCIS.....

Hi,
My fiance has filed for h1 extension. we will be travelling to india for marriage by dec. since petition papers are not expected to come by December, i was thinking if the following can be done
1. she comes along with me under h4 visa.
2. once petion paper comes, her visa status changes from h4 to h1 and then she can continue her job.
is this possible?
will h1 visa processing continue to happen when one comes to US under H4 visa.
kindly suggest.

I'm Australian and would like to return to the U.S. to visit in-laws with my partner but I overstayed my visa on my last visit.
On my last visit, I received a 6-month visitor visa then extended my visa another 6 months. I overstayed my visa by 11 weeks; I was helping my same-sex partner move. This was two years ago. I did not work for anyone while in the States.
What can I do if any to improve my chances of not getting turned away at Immigration?

I am on L1 and my wife was working on L2 + EAD since Aug-2007 with her employer.
She got her H1B approved in Oct-2009 with the same employer - which means that she automatically moved to H1B, correct?
We went to India but she gave her L2 I-94 on departure and did not give H1B I-94
She entered back to US on L2 on 03-Jan so I am assuming that her status has been updated to L2 now.
Please advise if at all she needs to move to H1B again since her L2 EAD is still valid.
If she needs to move to H1B, then what is the best way, we can easily go to Meixco for stamping from LA.

I just checked that Nebraska is now processing cases from August 2007 for I 140 applications. Do these also indicate China and India?
My pd for I 140 is in July, and I am from india. Should I be able to make a query since the dates have gone past my PD?

Hi,
I switched from H1 to EAD with the same employer. Due to family emergency i got to leave and may have to stay for more than 2+ months.
Would that be ok if i stay out of country while on EAD. I will be returning back using my AP.

Can someone suggest if I'm in a hot water over this issue. My company applied for the labor certification back in Dec. 2002. In the Labor Certification form they quoted 40 for the "Total hours per week". The LC was approved back in July of 2007. Later in Sept. of 2007 we filed I-140 and I-485 concurrently.
In April of this year my company received an RFE for the I-140, where USCIS requested some additional translations and my W-2 forms for all the years of my employment. We've responded to it.
So here's my question. Since 2002 my working schedule changed and now I work 32 hours per week, that is different than 40, which was included in the LC. It doesn't say anywhere in my W-2's, but one can easily see that I'm being paid less by doing some simple math.
Do you think this would pose a problem and if so, what shall I do at this point?

I am working on H1B visa as full time employee (Business Analyst) for a global manufacturing company. After going throughforums I understand that as consulting employees need client letters, similarly full time employees need in house project documentation for visa stamping. I work in IT department of my company where we maintain applications and provide production support and there is no specific project that I am working on. Should full time employees must have in house project documentation for visa stamping? Will I have any problem if I tell VO that I provide production support and am not working on a specific 1 project?
