Hi
My friend was on H1B visa from last 5.5 years and Laid off last week .
I want to know what options she has to stay in USA.
from last company her labor and 140 was approved .
Can she do visa transfer and start new labor ?
Its only 5-6 months left in her 6 year h1b visa .
Attorneys please reply .

if you are out of country then why don't open account in ICICI or reliance to do trading .

You should not have a problem getting a different visa to come to the US to work or visit, assuming you qualify for the new status. It's not unusual for someone to get a visa that they never use.

So I was one of the lucky (yes a bit of sarcasm) people that got transferred in July 2007 to be receipted in California even though we sent the papers to Nebraska. In Sept 2007 they told me they are now transferring my application to Nebraska. And guess what just today I got the update on CRIS that it is now pending at the Nebraska office.
What did they go on vacation for over a year or how can it take that long to transfer something that was never supposed to be transferred in the first place, because I did send it to the correct office, they just decided to move it because of receipting back ups.

One of my close friends got RFE on I-485. He is working for the Company A, but his labour and I-140 applied in June 07 from company B as substitution. Currently his I-140 got approved. But he got query as mentioned below. Can some one send sample letter .
You must submit a currently dated letter from your intended permanent employer, describing your present job duties and position in the organization, you proffered position (if different from your current date), the date you began employment and the offered salary or wage. This letter should be in the original and signed by an executive or officer of the organization who is authorized to make or confirm an offere of permanent
employment. The letter must also indicate whether the terms and conditions of your employment-based visa petition continue to exist.

I have EB2 PERM and EB3 I140 approved. Since my EB3 PD date is earlier than EB2 PD , my lawyer filed my 485 with EB3 I140.
Is there any way to find from 485 receipt or application which I140 was used for filing ?
Please advise.

Hi,
I just filed I-485 for myself and my wife. She is currently on OPT and has an approved EAD (F-1).
I can't seems to get a definite answer on how the filing will affect her status. Here's what I know so far, pls correct me if I am wrong:
1) F-1 is non-immigrant intent. Hence, when the I-485 is submitted she is no longer on F-1 but "AOS pending" status.
2) She "can" continue to work using the EAD. I said "can" because technically she is not supposed to but this is a grey area.
3) The PROBLEM is when she decides to travel. There is high risk that the immigration officer will see that she has filed I-485 and hence her F-1/OPT is no longer valid.
4) The PROBLEM in (3) can be circummvent if she uses AP from the I-485 application.
Am I missing anything? Thanks.

Also I have read conflicting responses e.g. some users have suggested not working and other have said you can work 180 days after EAD expires.

Hey everybody, My friend have a situation. He is from Haiti and he been in the USA since 1998 on a visitors visa but stayed. Graduated school, but couldn't do nothing else because of his papers, he lived with his sisters and they didn't work on it. Had a little situation in 2007 where he left the scene of an accident because he didn't have papers. They called it a felony, and now the (TPS) came around and he got denied because of that felony. He doesn't know where or what to do, don't have money for lawyers because he cant work. Anybody out there been there that knows what to do please feel free to do so. GOD bless

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case.
